How to register copyright?

You can register copyright in a work with the help of a specialized law firmor independently based on recommendations of our project.

The first step. If you decided to register copyright by yourself, you should prepare an application for registration in Ukrainian.

The second step. For filing of application it is necessary to pay the fee for preparation of copyright for registration, which is fixed at the following rates:

The third step. It is necessary to attach a copy of work in the established material form to the completed application and documents attesting payment of the fee and state duty. The following requirements to the material form are established for the works mentioned below:

Literary written works - in printed form in original language on paper or electronic carrier.

Verbal works - in printed form in original language on paper or electronic carrier.

Computer programs - in the form of a source (fragments of source) program to the extent necessary for its identification. At that you may decide by yourself, what fragments of the source computer program you deposit, and have the right to exclude from the filed fragments of source some parts, which should not be covered in your opinion.

Musical compositions with or without a text - in the form of a musical notation or sound record, and the text - in printed form in original language on paper or electronic carrier.

Dramatic, musical-dramatic works, pantomimes, choreographic and other works created for scenic performance, and their staging, as well as scenic adaptations of literary written works and adaptations of folklore suitable for scenic performance - in the form of videorecords, pictures or in printed form in original language on paper or electronic carrier.

Audiovisual works - in the form of a certificate of State Enterprise "Aleksandr Dovzhenko National Center" concerning the deposited original works (source materials and videorecords) and copies (on film or videocarriers), which require the special storage conditions.

Works of graphic art, photographic works, including works made by methods similar to photography, illustrations, maps, plans, drawings, sketches, plastic works related to geography, geology, topography, engineering, architecture and other lines of activity - in the form of photographs (if necessary - in color) sized 9 x 12 centimeters at least or slides, or on electronic carrier, or in form of copies on paper carrier.

Works of architecture, urban planning and landscape architecture - in the form of photographs (if necessary - in color) sized 9 x 12 centimeters at least or slides, or in form of copies of the basic drawings of design, first of all master plan, floor plans, facades, sections, other drawings (optionally), photographs or slides of models of the finished buildings and structures on electronic carrier, or in form of copies on paper carrier.

Works of applied art, including works of decorative, weaver's art, ceramics, carving, casting, art glass, jewelry, if they are not protected by the laws of Ukraine on legal protection of industrial property objects - in form of photographs (if necessary - in color) sized 9 x 12 centimeters at least or slides, or on electronic carrier.

Texts of translations for dubbing, scoring, subtitling in Ukrainian and other languages of Ukrainian and foreign audiovisual works - in printed form in original language on paper or electronic carrier, or in form of a videorecord.

Databases - in form established for filing of the corresponding copyright object being a component part of the database.

The fourth step. The completed application with attached documents is enclosed in a paper folder "with strings". This folder is filed or sent by mail to the Ukrainian Agency of Copyright and Related Rights , located at the address: 34 Bogdan Khmelnytsky Str., Kyiv, Ukraine, 01030.

In cases mentioned below the following documents may be also attached to an application :

• document certifying the fact and date of publication of a work, if the work was published earlier;
• power of attorney executed as established by law, if an application is filed by an authorized person;
• directions for use (user manual) of a computer program or database, if an application for registration of copyright is filed for a computer program or database;
• description of a database structure, if an application for registration of copyright is filed for a database;
• annotation is also attached to an application for registration of copyright in works of architecture, urban planning, landscape architecture and monumental art, which annotation should contain the title of work, its location (address), architectural characteristics and parameters, time and place of creation.

The fifth step. For approximately one month from the date of filing, if the documents were executed properly and the state fee and duty were paid, the State Department of Intellectual Property takes a decision on registration of copyright in a work.

The sixth step. In one month from the date of taking of the decision on registration of copyright the State Department of Intellectual Property grants a certificate of state registration of copyright in a work.

You can receive a certificate of state registration at the Ukrainian Agency of Copyright and Related Rightsor by mail according to the mailing address stated in the application.
